Terms of Service

1. Purpose

These Terms of Service govern access to and use of the PrivateMia service, an AI-powered virtual conversational companion available as a Progressive Web App (PWA). By using the service, you agree to these Terms.

2. Nature of the Service, Artificial Intelligence

You acknowledge that 'Mia' is a fictional character and that all conversations (messages, voice notes and images) are generated by artificial intelligence. The service is not a dating service and does not provide medical, psychological or professional advice or support.

If you are experiencing psychological distress, please contact a healthcare professional or an appropriate support service. If you are in immediate danger, contact your local emergency services.

3. Access, Adults Only

The service is strictly reserved for users aged 18 or older. During registration, you confirm that you are an adult (this confirmation is timestamped and stored). Any account identified as belonging to a minor will be deleted.

4. Account

Registration is completed by email using a one-time password (OTP). You are responsible for keeping access to your email account secure. Only one account per person is permitted.

5. Plans and Payment

Applicable prices are displayed in the application before payment. Payments are processed by Stripe. Each plan is offered on a monthly or yearly basis; the subscription renews automatically at each term and may be cancelled at any time. Cancellation takes effect at the end of the current period: access and benefits are retained until that date. No refund, whole or partial, is granted for a period already started, including a yearly one, because the service consumes artificial intelligence resources that are billed to the publisher as soon as they are used. A plan change mid-period is prorated, either as an immediate charge or as credit applied to subsequent payments, never as a refund.

6. Right of Withdrawal

The service provides access to digital content delivered immediately, without any physical medium. By requesting this immediate access, the user expressly consents to performance of the contract before the expiry of any withdrawal or cancellation period that may apply in their jurisdiction, and acknowledges that they waive this right once performance has begun with their express consent.

7. Acceptable Use

You may not use the service to request or generate illegal content, sexually explicit content involving minors, violent or hateful material, drug-related content, or to attempt to bypass the service's safeguards (quotas, filtering or security). The service may refuse requests, remove content, and suspend or terminate accounts that violate these rules.

8. AI-Generated Content

Content generated by the AI may be inaccurate, inconsistent or inappropriate. You are granted a personal, non-commercial right to use content generated within your account and agree not to distribute it for unlawful purposes.

9. Availability and Liability

The service is provided 'as is' without any guarantee of uninterrupted availability. To the fullest extent permitted by law, the publisher's liability is limited to the amounts paid by the user during the previous 12 months. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Account Termination and Deletion

You may request the deletion of your account and personal data at any time through our contact page or from the application settings. Deleting your account permanently removes your conversations, memory and associated media, except for data that must be retained to comply with legal obligations.

11. Changes to the Terms

We may update these Terms of Service. The version in force at the time you use the service applies. If substantial changes are made, you will be informed through appropriate means.

12. Governing Law and Disputes

These Terms are governed by French law. In the event of a dispute, users may first seek free consumer mediation (see the Legal Notice) before taking legal action. If no amicable resolution is reached, jurisdiction shall be determined in accordance with applicable law.
